Terms of Service

1. Acceptance of Terms

By creating an account on Carehia or using any of our services at carehia.com, app.carehia.com, or work.carehia.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use Carehia.

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email.

2. About Carehia — Platform, Not Employer

Carehia is a technology marketplace platform. We provide tools for families to discover, vet, book, and manage independent caregivers — and tools for caregivers to manage their work, clients, invoices, documents, and schedule.

Carehia is not:

• An employer, staffing agency, or home care agency
• A licensed home health care provider
• A party to any agreement between a client and caregiver

Caregivers who use Carehia are independent contractors, not employees of Carehia. Carehia does not control, direct, supervise, or guarantee the quality of services provided by caregivers. Families are solely responsible for evaluating and selecting caregivers.

3. Eligibility

• You must be at least 18 years old to create an account
• Caregivers must be legally authorized to work in the United States
• You must provide accurate, truthful information when registering
• You may not create an account on behalf of another person without authorization
• Accounts are non-transferable

4. Caregiver Terms

Listing your profile is free. You can create a caregiver profile, list your skills, availability, and hourly rate at no cost.

Pay-per-lead model: When a family books an interview with you, you will receive a notification. The client's contact details (name, phone, email, booking date/time) are blurred by default. To unlock a single booking and see full details, you pay a one-time fee of $4.99. Alternatively, subscribe to the Unlimited Plan at $19.99/month to unlock all incoming bookings at no additional cost.

Unlock fees are non-refundable once a booking is unlocked and client details are revealed.

Caregiver responsibilities:

• Provide truthful, accurate information in your profile
• Honor commitments made to clients through the platform
• Comply with all applicable laws, including tax obligations for self-employed individuals
• Maintain any certifications or credentials you list
• Conduct yourself professionally and respectfully

5. Client Terms

Browsing caregivers is free. No credit card required to view profiles, skills, and availability.

Client subscriptions unlock the ability to view caregiver contact information (phone, email):

• Essential — $15/month: Up to 5 contact unlocks per month
• Family — $29/month: Unlimited contact unlocks
• Premium — $59/month: Unlimited unlocks + dedicated care coordinator support

Booking interviews is free. You can book interview slots with caregivers at no charge.

Client responsibilities:

• Provide truthful information about care needs
• Honor scheduled interview appointments
• Conduct background checks and reference checks independently before engaging a caregiver
• Negotiate and manage your own employment or service arrangements directly with caregivers

6. Payments & Billing

All payments are processed by Stripe. By providing payment information, you agree to Stripe's Terms of Service. Carehia does not store your card number, CVV, or full payment details.

Subscriptions (client plans, caregiver unlimited plan) are billed monthly and automatically renew. You may cancel at any time through your account Settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued.

One-time unlock fees ($4.99 per booking unlock) are non-refundable once the booking details are revealed.

All prices are in USD. We reserve the right to change pricing with 30 days' notice.

7. Hire Agreements

Carehia provides an optional digital hire agreement tool to help clients and caregivers formalize their working relationship. These agreements are created and signed by users — Carehia is not a party to any hire agreement and does not provide legal advice. We recommend consulting an attorney if you have questions about your legal obligations.

8. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent information in your profile or listings
• Impersonate any person or misrepresent your qualifications, certifications, or identity
• Harass, abuse, threaten, or discriminate against other users
• Use Carehia to solicit payments or arrange services outside the platform in a way that circumvents our fees
• Scrape, copy, or reproduce any part of the Carehia platform without written permission
• Use Carehia for any unlawful purpose
• Attempt to access accounts, systems, or data that do not belong to you
• Post spam, advertising, or promotional content unrelated to caregiving

Violations may result in immediate account suspension or termination without refund.

9. Reviews & Ratings

Clients may submit reviews of caregivers after working with them. Reviews must be honest, based on real experiences, and comply with our community guidelines. Carehia reserves the right to remove reviews that are fraudulent, abusive, or violate these Terms. Caregivers may not offer incentives in exchange for positive reviews.

10. Intellectual Property

The Carehia platform, brand, logo, and all original content are owned by Carehia and protected by copyright and trademark laws. You may not use our name, logo, or content without written permission.

By uploading content to Carehia (profile photos, documents, bio text), you grant Carehia a non-exclusive, royalty-free license to display that content as part of operating the platform. You retain ownership of your content.

11. Disclaimers

CAREHIA IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:

• The platform will be uninterrupted or error-free
• Any caregiver listed is qualified, safe, licensed, insured, or background-checked
• The platform will meet your specific requirements

Background checks are not performed by Carehia. Families are strongly encouraged to independently verify caregiver qualifications, conduct interviews, and perform background checks before engaging any caregiver.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAREHIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO:

• Actions or omissions of any caregiver
• Personal injury or property damage related to care services
• Loss of data or unauthorized access
• Any disputes between clients and caregivers

Our total liability to you for any claim will not exceed the amount you paid to Carehia in the 3 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Carehia and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your breach of these Terms, or your violation of any applicable law or third-party rights.

14. Termination

You may delete your account at any time by contacting support@carehia.com. Carehia reserves the right to suspend or terminate any account that violates these Terms, at our sole discretion, with or without notice.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the American Arbitration Association's Consumer Arbitration Rules.

You waive any right to a jury trial or class action lawsuit in connection with any dispute arising from these Terms or your use of Carehia.
